Publishing listings is one thing. Getting paid because a lease got signed is another. The line most rental platforms have to worry about is not the listings themselves, it is the moment someone on your team negotiates terms, shows a unit, screens an applicant on an owner's behalf, holds tenant money, or earns compensation tied to the lease closing. At that point the platform is doing brokerage, and brokerage takes a licensed entity with a broker attached to it in that state.
The second trap is the lease. Every state we cover defines brokerage to include leasing and renting, not sales alone. Platforms that would never describe themselves as a brokerage land inside the definition anyway, because a lease is a real estate interest and somebody got paid to put it together.
